Terms of Service

§ 1. General Provisions
- These Terms of Service (hereinafter "Regulations") define the rules for using the services provided by Evolve Management Systems S.L. (hereinafter "Service Provider") through the website available at www.evolvems.es (hereinafter "Platform").
- These Regulations constitute a binding agreement between the Service Provider and any entity using the services (hereinafter "User"). By using the Platform, the User confirms that they have read, understood, and agree to be bound by these Regulations.
- The services offered are intended for business and professional users only. The User declares that they are using the services for purposes directly related to their business or professional activity. Consumer protection laws do not apply.
- The Service Provider reserves the right to amend these Regulations at any time. Information about changes will be published on the Platform. Continued use of the services after the changes take effect constitutes acceptance of the new Regulations.
§ 2. Definitions
- Platform – Refers to the website operated by the Service Provider at www.evolvems.es and its subdomains.
- User – An entity or individual with full legal capacity who uses the Services in connection with their professional or business activity.
- Account – A user profile created upon registration, allowing access to specific functionalities of the Platform or services.
- Services – Refers to all consulting, coaching, training, and informational services provided by the Service Provider as described on the Platform.
- Regulations – Refers to this document, the Terms of Service, governing the use of the Platform and Services.
§ 3. Type and Scope of Services Provided
- The Service Provider offers professional consulting services in the fields of HR strategy, corporate culture development, and executive coaching. The specific scope of services for each User is determined by a separate, individual agreement or statement of work, which supplements these Regulations.
- The Platform provides general information about the services, articles, and a means of contact. The use of this informational content is free of charge. Paid services are clearly marked and subject to a separate contract.
- The Service Provider makes every effort to ensure the accuracy of the information presented on the Platform but does not guarantee its completeness or suitability for any particular purpose. The content is for informational purposes only and does not constitute professional advice.
- To engage in a paid service, the User must contact the Service Provider through the Platform or other provided means to establish the terms of cooperation, which will be formalized in a written agreement.
§ 4. Technical Requirements
- Proper use of the Platform requires a device with internet access and a modern web browser (e.g., Chrome, Firefox, Safari, Edge) with JavaScript and cookies enabled. The Service Provider is not responsible for technical issues arising from the User's equipment.
- The User is responsible for ensuring the security of their own devices and data against unauthorized access or malware.
- The Service Provider does not guarantee uninterrupted availability of the Platform and reserves the right to schedule maintenance breaks.
§ 5. Rights and Obligations of the User
- The User agrees to use the Platform and Services in accordance with applicable law, social norms, and these Regulations. The User shall not provide any unlawful content or use the Services for illegal purposes.
- The User is obliged to provide true and accurate data when using contact forms or registering an account. The User is responsible for any consequences arising from the provision of false information.
- All intellectual property rights to the content on the Platform, including text, graphics, logos, and methodologies, belong to the Service Provider. The User may not copy, modify, distribute, or otherwise use this content without the prior written consent of the Service Provider.
- The User agrees not to take any action that could disrupt the proper functioning of the Platform, including interfering with its code, security measures, or transmitting viruses.
- Confidential information shared during the provision of Services will be protected in accordance with the terms of a separate non-disclosure agreement or the confidentiality clauses within the main service agreement.
§ 6. Final Provisions
- Any disputes arising from the implementation of these Regulations or the provision of Services shall be resolved amicably. If no agreement can be reached, the dispute shall be submitted to the competent court for the registered office of the Service Provider.
- The governing law for these Regulations and any service agreements shall be the law of Spain.
- If any provision of these Regulations is found to be invalid, this shall not affect the validity of the remaining provisions.
